CANCELLATION BY THE OPERATOR:

A departure date for a scheduled tour offered and operated by ISX Tours Canada will become a guaranteed departure when the minimum number of customers booked has been reached on that departure. ISX Canada guarantees that all scheduled Tour departures booked with full payment will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up to date Tour and itinerary information is available on the Tour Operator's website or by contacting the Tour Operator. Brochures and other printed materials displaying Tour information and departure dates are subject to change may not be relied upon for purposes of this guarantee.

If a Tour, offered and operated by ISX Tours Canada, is cancelled by ISX Tours Canada before the date of departure for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from the Tour Operator:

-  a substitute Tour of equivalent or superior value; or
- a substitute Tour of lesser value if no Tour of equivalent or superior value is reasonably available and to recover from the Tour Operator the difference in price between the price of the Tour originally purchased and the substitute Tour; or
- a full refund of all monies paid for the cancelled Tour.
In the event of a cancellation (by the supplier) of a travel service not operated but offered by ISX Tours Canada and where ISX Tours Canada acts solely as an agent for the suppliers, all effort is made to provide you with a suitable alternative of the travel service.
ISX Tours Canada is not responsible for any incidental expenses or consequential losses that you incur as a result of the cancelled travel service including visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment.
Where a significant element of a Tour as described cannot be provided after departure, ISX Tours Canada will make suitable alternative arrangements where possible.

DOCUMENTATION AND VOUCHERS:

We will issue a booking confirmation at time of booking.

UNUSED SERVICES:

There will be no refunds for services which are not utilized. Should passengers fail to arrive for their pre-booked service/product or voluntarily cancel, amend or otherwise alter their arrangements; ISX Canada will not be responsible for refunds. This is regardless of inferred or implied assurances on behalf of any of service providers.

RESPONSIBILITY:

ISX Tours Canada acts solely as an agent for the suppliers used in the program. Although great care is taken in choosing suppliers, we are unable to directly control them and therefore cannot be liable for their acts or omissions. The travel services are subject to the conditions imposed by these suppliers, and their liability may be limited to their tariffs, conditions of carriage, international conventions and agreements.

PASSPORTS AND TRAVEL DOCUMENTATION:

Visitors to Canada from all other countries require a valid passport to enter the country. Citizens of some countries may require a visa. It is your responsibility to check the validity of your passport, which should be valid well beyond your return date and to ensure it meets all requirements for admission into Canada. Many countries require your passport to be valid for six months beyond your travel dates or you may be denied Travel Services. Travellers who fly to Canada may also require an electronic travel authorization document. If you have any questions or concerns with respect to your ability to enter Canada, please consult Immigration and Citizenship Canada.  For current information on travel to Canada visit www.travel.gc.ca.

CHANGES TO THE ITINERARY:

Safety is our primary concern. Please note that on some tours, it may be necessary to modify the itinerary due to weather and / or road conditions. If so, we will endeavour to add other sights and activities to replace those omitted. If the itinerary is modified to one that is less expensive than the original, the client will be refunded the difference in cost between the original and modified itineraries. If the itinerary is modified to one that is more expensive than the original, the client's advance approval will be obtained, and the client will be charged the difference between the original and modified itineraries. If a tour is cancelled and no substitute tour is available or acceptable to the client, the client will be refunded the full cost of the tour minus any applicable vendor payments. The client is responsible for all additional transportation or lodging costs that are necessitated by weather. In addition, if a client has planned to travel by air to a tour or lodging facility that can also be accessed by ground transportation, there will be no refund if the air transportation is cancelled and the client chooses not to access the tour or lodging facility by ground transportation. There are no refunds if a tour operates but the client decides due to weather or any other reason not to participate. Participation in activities, tours, and transportation is not mandatory and purely voluntary. We strongly recommend travel insurance to help protect against unforeseen circumstances.

RESPONSIBILITY AND ACKNOWLEDGEMENT OF RISK:

ISX Tours Canada acts only as an agent for the various independent suppliers that provide overnight accommodations, transportation, sightseeing, activities, or other services connected with the itineraries it arranges (hereinafter: "the services and activities"). The services and activities are subject to the terms and conditions of those suppliers as well as those contained herein.

FORCE MAJEURE:

If the Tour Operator is prevented or restricted directly or indirectly from carrying out all or any of its obligations under these Terms and Conditions for any cause beyond the reasonable control of that Party ("Affected Party"), including (without limiting the generality of the foregoing) war, civil commotion, riot, insurrection, strikes, lock-outs, fire, explosion, floods and acts of God (each a "Force Majeure Event"), ISX Tours Canada shall be relieved of its obligations hereunder for the period of the Force Majeure Event. In such instance ISX Canada shall not be liable for any delay or failure in the performance of any of its obligations hereunder or for any loss or damages which the other Party may suffer due to or resulting from any such delay or failure, provided that written notice of the inability to perform is given by ISX Tours Canada within 48 (forty eight) hours of the commencement of the Force Majeure Event.

You understand and agree that, as a condition of booking Travel Services through ISX Tours Canada, you and all participants in any Travel Services waive all claims and agree to defend, release and indemnify ISX Canada, its employees and agents from any and all liability or damages arising in any way from any Travel Services.

You understand that travel and participating in the Travel Services can involve dangers and inherently risky activities that may result in death, personal injury, loss or damage to property, delays, inconvenience, extra costs or other losses.

ISX Canada, its employees and agents shall under no circumstances be liable for any representation, misrepresentation or information given or omitted in relation to the suitability of any Travel Services, visas, passports, health issues, insurance issues, taxation or any other matter.

ISX Canada, its employees and agents shall also under no circumstances be liable for any loss or damage including injury, death, loss of personal effects or luggage, loss of revenue or profit, costs, expenses, delays, inconvenience, loss of enjoyment or emotional upset, no matter how caused, whether or not due to any act, omission or negligence of ISX Tours Canada, its employees or agents.

In the alternative, should the Liability Release & Agreement Not to Sue contained above be found unenforceable for any reason, all liability of ISX Canada shall be limited to the lesser of the total price of the Travel Services.

If we are unsuccessful in resolving your concern, and your claim is for any reason not covered by the Liability Release & Agreement Not to Sue detailed above, you agree that any claim relating in any way to any Travel Services arranged through ISX Tours Canada is null and void unless notice is provided in writing within 60 days of the completion of any Travel Services and unless arbitration proceedings are commenced within one (1) year of the completion of any Travel Services.
